Definitions as used in the terms and conditions: The use of the terms “you”, “your”, or “customer” is in reference to any user of this site, purchaser or installer of a product supplied by RIDE ON GEAR, or a user of services or instructions provided by RIDE ON GEAR.

 

By using this site, purchasing products, installing products, or use of services or instructions from RIDE ON GEAR, you the customer agree to the terms and conditions listed below. If you are not in agreement to these terms, discontinue the use of all the above from RIDE ON GEAR.

 

RIDE ON GEAR reserves the right to make changes to our site, policies, and terms of use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Unless otherwise specified, all logos, text, pictures, and content appearing on this site, are the sole property of RIDE ON GEAR.

This site may contain links to other sites on the Internet that are owned and managed by third parties that are not under our control. You acknowledge that RIDE ON GEAR is not responsible for the operation of or content located on or through any such third party site.

All items purchased from RIDE ON GEAR are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

The customer receipt of an electronic or other form of order confirmation does not signify RIDE ON GEAR acceptance of your order, nor does it constitute confirmation of our offer to sell the product. RIDE ON GEAR reserves the right at any time after receipt of your order to accept or decline your order for any reason.

In the event a product is listed at an incorrect price due to typographical error or error in pricing information, RIDE ON GEAR reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. RIDE ON GEAR shall maintain the right to refuse or cancel any such orders whether or not the order has been confirmed and the customer credit card charged. If the customer’s credit card has already been charged for the purchase and the order is canceled, RIDE ON GEAR shall immediately issue a credit to the customer’s credit card account in the amount of the incorrect price that was paid.

You the customer agrees to defend, indemnify and hold harmless RIDE ON GEAR from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of use of products or services provided from RIDE ON GEAR.

Costs and risk of loss for return shipments is the responsibility of the customer. All returns must get prior written authorization from RIDE ON GEAR prior to being sent. This includes but is not limited to warranty claims. RIDE ON GEAR maintains the sole discretion to determine warranty applicability and validity. Once a product has shipped, cancelation of an order is not able to occur. Any returns other than a warranty related issue shall be dealt with on a case by case basis, and subject to but not limited to a 25% restocking fee in addition to the customer’s responsibility to ship the product as previously stated. If a warranty is not listed or included under the individually listed product, then no warranty is included or inferred.

 

LIABILITY STATEMENT
RIDE ON GEAR products are designed to be used on factory unmodified ATVs or UTVs. Adding, modifying, or fabricating any factory or aftermarket part is not recommended. Operating any off-road machine while, or after, consuming alcohol and/or drugs increases risk of bodily harm or death. No warranty or representation is made as to this product’s ability to protect the user from severe injury or death. RIDE ON GEAR highly recommends operators and occupants to wear a helmet and appropriate riding gear at all times. By purchasing and installing RIDE ON GEAR products, the user agrees that should damages occur, RIDE ON GEAR will not be held responsible for loss of time, use, labor fees, replacement parts, or shipping charges. RIDE ON GEAR shall not be held responsible for any direct, indirect, incidental, special, or consequential damages that result from any product purchased from RIDE ON GEAR. The Buyer is responsible to fully understand the capability and limitations of their vehicle according to manufacturer specifications, warnings and instructions, and agrees to hold RIDE ON GEAR harmless from any damages or injuries resulting from failure to adhere to such specifications, warnings and/ or instructions.
